These Terms of Service ("Terms") govern your use of the Penny mobile application ("the App"), developed by Claudiu Sararu ("I," "me," or "the Developer"). By downloading, installing, or using Penny, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to them, do not use the App.

1. Description of the Service

Penny is a book tracking application for iOS that allows you to:

Search for and add books to a personal library using data from Google Books, Open Library, and Apple Books
Organize books on shelves (To Read, Reading, Finished, DNF, and custom shelves)
Track reading sessions with a built-in timer and Live Activities
Record notes, glossary entries, and character details for each book
View reading statistics and progress toward reading goals
Scan book barcodes using your device's camera
Listen to ambient reading soundscapes
Sync your library across your Apple devices via iCloud
Import and export your library data

Penny is available in a free version with core functionality and a premium version with additional features.

2. Acceptance of Terms

By creating a library, adding books, or otherwise using the App, you confirm that:

You are at least 13 years of age (or the minimum age required in your jurisdiction).
If you are under 18, you have the consent of a parent or legal guardian.
You agree to comply with these Terms and all applicable laws and regulations.

3. User Responsibilities

When using Penny, you agree to:

Use the App only for its intended purpose of personal book tracking and reading management.
Not attempt to reverse-engineer, decompile, or derive the source code of the App.
Not use the App to infringe upon the intellectual property rights of others.
Not attempt to circumvent any security features, premium restrictions, or technical limitations.
Not redistribute, sublicense, or resell the App or any part of it.

You are solely responsible for the data you enter into the App.

4. In-App Purchases and Subscriptions

4.1 Premium Plans

Penny offers the following optional premium purchases:

Monthly Subscription: $2.99 USD per month
Yearly Subscription: $19.99 USD per year
Lifetime Purchase: $39.99 USD (one-time payment)

Prices are in United States Dollars. Actual prices may vary by region and currency as determined by Apple.

4.2 Auto-Renewable Subscriptions

The Monthly and Yearly plans are auto-renewable subscriptions. By purchasing a subscription:

Payment will be charged to your Apple ID account at confirmation of purchase.
Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price.
Management and cancellation: Go to Settings > [Your Name] > Subscriptions on your device. Cancellation takes effect at the end of the current billing period.
No partial refunds for the remaining portion of a canceled period.

4.3 Lifetime Purchase

The Lifetime purchase is a one-time, non-consumable in-app purchase that grants permanent access to all current and future premium features. No recurring charges apply.

4.4 Free Trial

If a free trial is offered, its duration and subsequent subscription price will be clearly disclosed. Any unused portion of a free trial will be forfeited when you purchase a subscription.

4.5 Price Changes

I reserve the right to change subscription prices. Changes take effect at the start of the next billing period. Apple will notify you of price changes, and you may cancel before the new price takes effect.

4.6 Payment Processing

All purchases are processed by Apple through the App Store. I do not receive or store any payment information. For billing questions, contact Apple Support.

4.7 Refunds

Refund requests must be submitted to Apple at reportaproblem.apple.com. Refund decisions are made by Apple.

5. Intellectual Property

5.1 App Ownership

Penny, including its design, code, graphics, mascot, icons, soundscapes, and all other original content, is the intellectual property of Claudiu Sararu. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

5.2 Your Content

You retain ownership of all content you create within the App, including notes, reviews, glossary entries, and character records. I do not claim any rights to your content and have no access to it.

5.3 Third-Party Content

Book metadata displayed in the App is sourced from Google Books, Open Library, and Apple Books, subject to their respective terms of use.

5.4 Feedback

If you provide feedback or suggestions, you grant me a non-exclusive, royalty-free, perpetual right to use and incorporate that feedback without obligation.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, I disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

I do not guarantee the accuracy of third-party book metadata, uninterrupted service, iCloud sync reliability, or continued availability of third-party APIs.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAUDIU SARARU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL.

Total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim, or fifty dollars ($50 USD), whichever is greater.

Some jurisdictions do not allow these limitations. In such cases, limitations apply to the fullest extent permitted by law.

8. Indemnification

You agree to indemnify and hold harmless Claudiu Sararu from any claims arising from your use of the App in violation of these Terms, your violation of any law, or any content you create through the App.

9. Termination

By You

You may stop using the App at any time by deleting it. Remember to cancel any active subscription through your Apple ID settings.

By Me

I may discontinue the App at any time. If discontinued, you retain access to the installed version, active subscriptions won't renew, and your local data remains on your device.

The App connects to third-party services governed by their own terms:

11. Governing Law

These Terms are governed by the laws of Romania. Disputes shall first be resolved amicably; if not, they shall be submitted to the competent courts of Romania. Nothing limits your rights under mandatory consumer protection laws of your jurisdiction.

12. Changes to These Terms

I may update these Terms from time to time. Material changes will be noted by updating the "Last Updated" date. Your continued use constitutes acceptance of revised Terms.

13. Severability

If any provision is found unenforceable, it will be limited to the minimum extent necessary, and remaining provisions continue in full force.

14. Entire Agreement

These Terms, together with the Privacy Policy and Apple's standard End User License Agreement, constitute the entire agreement regarding the App.

15. No Waiver

Failure to enforce any right or provision shall not be considered a waiver of that right.

16. Apple-Specific Terms

You acknowledge that:

These Terms are between you and Claudiu Sararu, not Apple.
Apple has no obligation to provide maintenance or support for the App.
Apple is not responsible for any claims relating to the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms.
